Writer sentenced to 3 months for defamation

AMMAN — The Amman Magistrate Court ruled Wednesday on a case filed by the Public Prosecutor against writer and political activist Adnan Al Rousan, acquitting the defendant of broadcasting, through social media sites, false news that could undermine the prestige and status of the state, contrary to Article 132/1 of the Penal Code, Ammannet reported.اضافة اعلان

It also acquitted him of the crime of incitement, based on the provisions of Article 150 of the Penal Code and Article 15 of the Cybercrime Law.

Yet, pursuant to the provisions of Article 177 of the Code of Criminal Procedure, the court convicted the defendant of the offense of defaming a public official, in accordance with the provisions of Article 196/2 of the Penal Code and Article 15 of the Cybercrime Law, and sentenced him to imprisonment for a period of three months and payment of legal fees.

He was also found guilty of defaming an official institution, in violation of the provisions of Article 191 of the Penal Code and in the context of Article 15 of the Cybercrime Law, and sentenced to a prison term of three months and payment of legal fees.

Since the two penalties are identical, and pursuant to the provisions of Article 72 of the Penal Code, the court decided to impose only one of the penalties against the defendant, so the enforceable penalty becomes three months’ imprisonment plus payment of legal fees (the period spent in detention, August 15 to September 13, will be calculated as part of sentence served).

The ruling is subject to appeal.
