Chairman of the Parliamentary Legal Committee, MP Dr. Aref Al-Sa'aydeh, clarified that adopting the provision regarding railways in the draft Real Estate Property Law was not an arbitrary decision. Rather, it was based on legal and legislative studies, judicial precedents, and insights drawn from comparative international legislation.

In press statements made today, Al-Sa'aydeh affirmed that the committee reviewed international experiences that classify railways as part of the public transportation system, noting that railways constitute a public utility infrastructure.
He stressed that the provision strikes a balance between the public interest and private property rights, while simultaneously guaranteeing fair compensation for property owners and upholding their right to seek judicial recourse, citing judicial rulings and precedents from the European Union and the United States.
Al-Sa'aydeh explained that legal precedents consider railways an integral component of public transit, and that constructing railway lines serves the public good—thereby enabling the application of eminent domain and statutory right-of-way provisions in accordance with applicable legal frameworks.
He pointed out that this approach aligns with international best legal practices and contributes to strengthening national transport projects while safeguarding property owners' rights.
He added that railway projects play a pivotal role in stimulating investment, reducing transportation costs, supporting industrial zones, and boosting tourism—ultimately driving economic development and elevating the efficiency of the Kingdom's transportation network.
